IN ADDITION TO YOUR RIGHTS UNDER THE ACL AND ANY MANUFACTURER’S GUARANTEE, OUR PRODUCTS COME WITH THE FOLLOWING WARRANTY

1. In this document:

  • “100% Leather Upholstered Product” means a Product which is upholstered with 100% leather;
  • “ACL” means the Australian Consumer Law;
  • “Bonded Leather Upholstered Product” means a Product which is upholstered with bonded leather;
  • “Fabric Upholstered Product” means a Product which is upholstered with fabric;
  • “Manufacturer’s Guarantee” means an express guarantee or warranty provided by the manufacturer of a Product;
  • “Product” means a product sold or supplied by Furniture City to You directly as a consumer;
  • "Structural Components" means the frame and where the context dictates, the foam, foundation and mechanisms.
  • “Furniture City”, “Us” or “Our” means Furniture City Australia Pty Ltd 096 231 337;
  • “Warranty” means this warranty against defects of a Product sold or supplied to You by Us;
  • “Warranty Period” has the meaning given to that term in clause 3; and
  • “You” means the person to whom the Product has been sold or supplied by Us.
  • 2. This Warranty is in addition to all of the rights you have under the ACL or under an express warranty or guarantee given by a manufacturer under a Manufacturer’s Guarantee.

    3. In addition to any other guarantee or warranty implied by law, Furniture City warrants that from the date of purchase, all Products (or components of Products as the case may be) will be free from defects in workmanship and materials for the following periods (each a “Warranty Period”):

  • For the Structural Components and covering of an Everyday Product, a period of 1 year.
  • For the Structural Components of a 100% Leather Upholstered Product, a period of 5 years.
  • For the Structural Components of a Bonded Leather Upholstered Product, or a Fabric Upholstered Product, a period of 1 year.
  • For the upholstery of a 100 % Leather Upholstered Product, a period of 1 year.
  • For the upholstery of a Fabric Upholstered Product or a Bonded Leather Upholstered Product, a period of 1 year.
  • For electric motors installed in 100 % Leather Upholstered Products, Bonded Leather Upholstered Products or Fabric Upholstered Products, a period of 1 year.
  • SCOPE OF WARRANTY

    4. Unless excluded under clause 7, this Warranty covers all parts and materials of the Product found to be defective in workmanship or materials during the applicable Warranty Period.

    5. Where a defect in the Product is identified within the Warranty Period which is a “Major Defect”, we will at your option provide a full refund, replace the Product or repair it.

    6. Where a defect in the Product is identified within the Warranty Period which does not constitute a “Major Defect”, we will at our option, replace the Product, repair the Product or provide you with a full refund.

    7. A Major Defect occurs when:

    You (acting reasonably) would not have purchased the Product if You had been fully aware of the extent of the defect; or the Product departs in a significant respect from any description, sample or model; or the Product is substantially unfit for purpose and cannot be easily remedied within a reasonable time; or the Product is unsafe. Scuff marks, tears to dust covers and small tears generally will not constitute a Major Defect under this Warranty. Furniture City’s liability under this Warranty does not extend to: damage, failure, fading or loss or deterioration of finish quality caused by normal wear and tear; or damage caused by improper use, assembly, maintenance or storage of a Product; or corrosion caused by improper care or improper maintenance; or damage caused in circumstances where the Product has been used commercially; or breakage or damage to glass table tops or mirrors; or defects in a Product which have been brought to your attention prior to purchase. HOW TO CLAIM To make a claim under this Warranty, simply follow these steps: Locate your receipt (or other proof of purchase acceptable to Us) which proves the date on which you purchased the defective Product. Where the date of purchase cannot be verified Furniture City will estimate the date based on the date of manufacture, the condition of the Product and the type of defect. Contact the store from which you purchased the Product.
